These SMS Terms & Conditions (“SMS Terms”) govern text messages sent by or on behalf of Coldwell Banker Bain (“we,” “us,” or “our”) to the mobile number you provide or that is provided for transaction communications.
1) Program Description
We use SMS/text messaging for two purposes:
- Transaction Partner Updates (Transactional / Customer Care): messages to real estate agents involved in an active real estate transaction with our brokerage (e.g., pending acknowledgment, escrow coordination/support, and closing confirmation).
- Optional Recruiting/Networking (Opt-In Only): occasional messages such as coffee/lunch invitations or a link to learn more about our company, sent only after you explicitly opt in (for example, by replying “YES” to an invitation message).
2) Message Frequency
Message frequency varies. Transactional messages are limited to the timeline of a specific transaction. Optional recruiting/networking messages are occasional and only sent if you opt in.
3) Opt-In and Consent
- Transactional messages: If you are an agent participating in an active transaction with our brokerage, your mobile number may be provided through MLS/transaction documentation for transaction communication. We only use SMS for messages related to that specific transaction.
- Optional recruiting/networking messages: We do not send these messages unless you explicitly opt in (for example, by replying “YES” to an invitation message).
4) Opt-Out and Help
You can opt out at any time by replying STOP to any message. After you opt out, you may receive one additional message confirming your opt-out.

5) Costs
Message and data rates may apply depending on your mobile carrier plan. You are responsible for any charges from your mobile carrier.
6) Supported Carriers / Service Reliability
Wireless carriers are not liable for delayed or undelivered messages. Message delivery is subject to your carrier’s network availability and other factors outside our control.
7) Privacy
